Legislation in Panama seeks to stimulate economic activity, which is why the country’s tax policy, based on the principle of territoriality, establishes that income from operations completed outside Panamanian territory are tax exempt.

Regarding trusts, Panama is the Latin American country with the longest history of fiduciary legislation, which dates back to 1921.

At present, trusts in Panama are regulated pursuant to the following

5 of January, 1984

Regulates Trusts as well as other dispositions

Executive Decree no. 16
3 of October, 1984

Enables execution of Law No. 1, which regulates exercise of the Trust business

Agreement no. 12-2005
14 of December, 2005

Sets restrictions on the use of banking and Trust services
